The application, numbered 2170/24, was submitted by Kavala on 18 January 2024.
Kavala's first application to the ECtHR dates back to 8 June 2018. In its first decision on 10 December 2019, the court found violations of Article 5 §1 and §4, and Article 18 in conjunction with Article 5 §1 of the European Convention on Human Rights. The ECtHR ordered Turkey to secure Kavala's immediate release.
Following Turkey's failure to comply, the Committee of Ministers of the Council of Europe initiated infringement proceedings in February 2022 under Article 46 §4 of the convention. On 11 July 2022, the ECtHR found that Turkey had not complied with its 2019 judgment.
In his second application, Kavala alleges violations of Articles 3, 5, 6, 7, 10, 11 and 18 of the European Convention on Human Rights. The ECtHR held a hearing on 25 March 2024 to hear the parties. The case is being heard by the Grand Chamber.
The announcement will take place in Strasbourg. There is uncertainty regarding the date of the decision, with various sources citing different timelines ranging between 2024 and 2026.
Kavala was arrested in October 2017 in connection with the Gezi Park case. His prolonged detention has been a point of contention between Turkey and the Council of Europe.
